Condition of Sale.

When purchasing a product from Toursareus.co.uk Ltd it is your responsibility to read and understand the terms and conditions as set out below.

Failure to receive successful payment at any stage will result in cancellation

Ticket Sales.

(1a) Ticket Sale Status is shown on our Web site as follows:

(1b) Ticket only sales: Full Payment is taken unless otherwise stated as in the case of Ticket Prices Are Provisional we only take a £25 deposit per ticket, we will only charge the advertised price with the proviso that when the dates/prices are confirmed this will be charged and any balance owing will be paid to Toursaresus by Credit / Debit card as furnished at time of booking failier to do so will forfeit your ticket booking.

(1c) Ticket bookings: for MotoGP, World Superbike tickets and Passes including Craner Curve / Goddards Corner / MotoGP VIP Village / SBK VIP Hospitality are sold on a first come first served basis. These must be paid for in full at the time of booking and are non-refundable.

(1e) Ticket allocation: We cannot guarantee to seat you in a specified area but will endeavor to do so. If tickets you have ordered cannot be supplied we reserve the right to supply an alternative of similar value and to make any monetary adjustment due in either way

(2a) MotoGP VIP Village Passes: whether they are booked on their own or as part of a package must be paid for in full at time of booking. They are allocated personally and are non-refundable and non-transferable.

Hotel Rooms and Package Sales.

(3a) Hotel room only sales: [1st Gear Option]
Full Payment is taken at the time of booking.

(3b) Hotel inclusive packages: [2nd, 3rd, 4th Gear Options]
A Deposit of £50 per person secures your place unless booked at less than 8 weeks notice in which case full payment is required.

(3c) Hotel inclusive packages: [5th & 6th Gear Options)
A deposit of £99 for the hotel is taken plus FULL payment for " MotoGP VIP Village Passes" unless booked at less than 8 weeks notice in which case full payment for the whole package is required. [Unless otherwise agreed by Toursareus and you in writing]

(3d) The ticket portion of a hotel package: is non-refundable in the case of cancellation by you.  However we at Toursareus.co.uk Ltd will endeavor to resell your ticket for you charging a fee of 25% per ticket if so requested but with no guarantee of success of the sale.

(3e) The ticket/s portion of a event package: Once the Ticket/s - VIP Passes price/s are announced we (Toursareus) will charge the value of those tickets of your event package you have booked, "this normally happens when the circuit has not issued the correct prices earlier in the season". (This payment is in addition of the deposit already paid to Toursareus) the remaining balance will be due 8 weeks before the event start date, this is done automatically with the credit/debit card you issued to us (Toursareus) at the time of booking. (Unless Prior Arrangments Have Been Agreed Between you the Customer & Us at Toursareus in Writing, Email Etc).

(3f) The VIP Pass/Ticket portion of a hotel package: is non-refundable in the case of cancellation by you.

Deposits.

(5a) All deposits are as follows: Tickets £25 each, Packages £50 each, VIP Passes £99 each

(5b) All deposits: paid are non refundable. By the paying and receiving of said deposits you are entering into a binding contract with Toursareus for the products as stated on your invoice and confirmation.

(5c) VIP Passes: Balance of payments for VIP Passes please see section "7b".

Confirmations.

(6a) All bookings: will receive confirmation by e-mail, or by post if requested.

(6b) Confirmations: Please check all information contained in your confirmation and invoice immediately upon receipt carefully. It is your responsibility to notify us of any errors within seven days. Toursareus is not liable for any errors howsoever caused after seven days following the date of confirmation.

Balance of Payments.

(7a) Balance of payments for packages: must be received at least 8 weeks prior to the first day of arrival at your hotel at your chosen event. Customer balances will be charged automatically to the credit / debit card details furnished at time of booking unless other form of payment is advised or given before this date, this must informed to Toursareus in writing by e-mail or letter. Failure to receive successful payment will result in cancellation of your package and forfeit of the monies already received. If booking with less than 8 weeks notice payment must be made in full.

(7b) Balance of payments for VIP Passes: In all cases where a MotoGP VIP Village Passes are booked as part of a package they are allocated personally and are non-refundable and non-transferable. Once we (Toursareus.co.uk Ltd) have the invoice from our supplier we will take the full balance of payment (VIP Passes only the hotel portion will be taken 8 weeks before the event date "see section 3e"), this will be taken from your Credit / Debit card automatically. (No Refund on these type of passes are paid back payment is full and final this includes deposit/s made as apart of a package or passes only)

Cancellations Transfers and Extra's.

(8a) Cancellation of tickets: Ticket sales are non-refundable.  However we at Toursareus.co.uk Ltd will endeavor to resell your ticket for you charging a fee of 25% of the value of your ticket(s) if so requested but with no guarantee of success of the sale..

(8b) If you cancel a package : In the unfortunate event of you having to cancel a package booking you may

(8c) Option 1:
Transfer your booking to another person to go to the same event up 28 days prior to first day of arrival at your hotel without penalty. This must be done in writing with the knowledge and agreement of Toursareus.co.uk Ltd.

(8d) Option 2:
Transfer your booking to another person to go to the same event between 28 and 7 days prior to first day of arrival of your booking there will be a charge of £30 per booking to cover administration costs with the addition of any charges imposed by the hotel or the suppliers to us. Both the transferor and transferee will be jointly and severally liable for any outstanding payments.

(8e) Option 3:
Transfer a booking to a different event if more than 8 weeks prior to the event start date, you may transfer to another event where available section 8a, 8c applies. If less than 8 weeks before the event start date you have booked sections 8a, 8d applies. Any monies due for a package of higher value will be charged to you. If transferred to a package of lower value no refund will be paid by Toursareus.co.uk Ltd.

(8f) Option 4:
If you cancel [8] eight weeks or less before any event start date you forfeit any payments [Including Deposits], but section's 8c, 8d, 8e will apply, you may exercise these options. the portion ticket under section 8a also apply's.

(8g) Option 5:
If the resale of your package under setions 8a, 8c, 8d or 8e you are not entiteld to any refund what so ever.

(8i) Extras bills: Any extra’s charged to your room are the customer’s responsibility and must be settled before departure. These include food, unless otherwise stated, bar and mini-bar, pay per view, taxis, papers, activities, excursions, tolls, car hire and or fuel. In the case of these not being settled Toursareus.co.uk Ltd reserves the right to make a charge of £50 in addition to the outstanding bill and will be collected from your credit card automatically otherwise this may lead to a claim to recover the funds through legal action.

(8j) If We Cancel: We reserve the right to cancel if there are not sufficient numbers to make any event commercially viable. In which case we will offer you an alternative of a similar value or a full refund of monies paid including deposits

(8k) Surcharges: Toursareus.co.uk Ltd reserves the right to charge any extra charges imposed, this will be passed on to the customer. These are items like extra cost on delivery - packaging - coach hire - hotel rooms - driver hire - fuel.

(8L) Currency Fluctuations: Circumstances beyond our control may dictate an increase in the cost of your package or tour. Any increase less than 2% of the published price will be absorbed within the original price, - any increase over 5% we may need to add to the final invoice.

Hotels.

(9a) All hotels: have been checked by us Toursareus.co.uk Ltd and are of 3 star rating or better in their country of origin or better unless otherwise stated. If we have to change hotels from those specified in our brochure they will be of at least comparable standard.

(9b) Breakfast: All events come with a standard continental breakfast
Evening Meals Evening meals are NOT supplied unless otherwise stated. MotoGP VIP Guest are entitled breakfast at the hotel as well as at the VIP Village located at the circuit.

Delivery / Care of Tickets and Passes.

(10a) All Tickets and Passes will be sent by secure courier and have to be signed for at delivery address and by the person named on the invoice, with the exception of package inclusive passes which will be issued on first night of hotel arrival. The cost of secure delivery of tickets sent by courier is charged (Please Refer to our Web Site When Making your Order) within for delivery in the UK. We recommend you the customer takes out an insurance to cover the delivery in the case of No delivery or lost Tickets, (Normally if paying by Credit Card this is covered if over the value of £100 (PLEASE CHECK WITH YOUR CREDIT CARD COMPANY), Once signed for they become you the customer’s responsibility.

(10b) Ticket Delivery can take up to 5 days and will be received by you before the events starts. We shall send them as soon as we receive them this is typically 1-3 weeks prior to the event. We will send you an e-mail once the tickets have been collected by the courier. In the case of non-delivery by the expected date please notify Toursareus.co.uk Ltd immediately as soon as possible.

(10c) Any additional cost: Loss of your tickets After delivery to you either by hand or by other method Toursareus co.uk Ltd will not be liable for any such loss or consequential expense thereafter. (Most tickets will not be able to replaced at such a late stage) where possible you can purchase new replacement tickets from us if available.

(10d) Claims In the event of loss or damage to tickets by the courier Unfortunetly No Courior Service Will Cover Tickets/Event Tickets. Damaged goods must be kept in a safe place, along with the original packaging, and made available for inspection by us (Toursareus.co.uk Ltd and the courier service or its appointed assessor. In the event of your having to make a claim against the courier.

(10e) Consequential Loss: There are NO insurance cover and is not provided by the courier or Toursareus.co.uk
Once signed for they become you the customer’s responsibility. We are unable to make any refunds on unused, lost / damaged or mislaid tickets by you, once delivery has been made and signed for.

(10f) UK Orders / Tickets Returned back to us: (Per Order) Any Returned Orders / Tickets will be charged at £20. (Returned Breakdown Cost £10 Charge to Toursareus plus £10 redelivery to you, Total Cost £20) The £10 Return Charge by the Courier will be Charged to your Credit / Debit Card Automatically.

(10g) Overseas Orders / Tickets Returned back to us: (Per Order) Any Returned Orders / Tickets will be charged at £20. (Returned Breakdown Cost £20 Charge to Toursareus plus the relavant cost for the country to redelivery to you) The £20 Return Charge by the Courier will be Charged to your Credit / Debit Card Automatically.

Travel Details.

(11a) Your Travel arrangements: Toursareus.co.uk Ltd will NOT supply any flights, or any other form of transport to the hotel where the event is taking place, it is the responsibility of the customer to make their own arrangements.

(11b) Passports and Visa’s: AII passengers must be in possession of either a valid Ten Year British Passport (with right of abode in the UK) or EC Passport. If visas are required you are reasonably expected to obtain the correct documentation. If you are traveling on a passport different to the above, then visas, and/or return/re-entry permits may be required for the country of destination or countries being transited and it is the responsibility of the passenger to ensure that they are in possession of the correct documents.

Motorcycle Tours / Motorcycle Other.

(12a) Motorcycle Tours: All riders must be in possession of a full and valid license for the class of machine they are using.

(12b) Your Motorcycle: We only accept motorcycles that are road legal, with registration plates, insured and in good condition with a current MOT, if appropriate. Each participant is responsible for their motorcycle, for their use of it and for the conformity of it with the laws in force. He or she is responsible for their pillion passenger.

(12c) Motorcycle Insurance: Each participant must be in possession of valid insurance for their vehicle, for themselves (and their pillion), a valid repatriation insurance for the vehicle for themselves (and their pillion), a civil liability for themselves (and their pillion). Any incident or accident that may happen to a participant (or their pillion) will not be accepted as the responsibility of Toursareus.co.uk Ltd unless directly involved in the incident.

(12d) The mechanical breakdown: or order of a machine or any repair or services required will be the responsibility of its owner. If for any reason the participant decides to leave a tour before the end he or she will not receive any refund in anyway shape or form i.e. money - credit or towards another event we host or hold.

Conduct.

(13) If a participant disrupts: any event or has cause to disturb any other  participant on one of our events they will be asked to leave and no refund will be given in anyway shape or form i.e. money - credit or towards another event we host or hold.

We do not cover.

(14) We do not cover: any vehicle you drive or own, you must supply any personal and medical insurance which covers repatriation of you, your pillion or your machine in the event of illness and/or accident or death and suggest that you take out your own. Check that this insurance covers Abandonment/Cancellation. Each person should carry the E111 form available free from Post Offices which gives you basic medical cover free within the EC but in the event of a serious illness or accident does not cover repatriation costs. Most hospitals outside the UK will not treat you if you don’t have an E111.

Our Responsibility.

(15a) We Are Responsible: For Any part of the program booked by us, where it is within our control, to ensure that it meets the standards as described in the brochure or publicity we use.

(15b) We Are Not Responsible: for some amenities being out of order due to service requirements, weather conditions or lack of demand due to low client numbers in the hotel, your death or that of any other that are with us at any hotel or event, or personal injury or illness caused by activities in which a participant engages which is outside of the event/hotel provided by Toursareus.co.uk Ltd.

Delays.

(16) Delays: We are not responsible for any terrorist acts or act's of god that will interrupt you stay or booking with us in anyway shape or form, we cannot be held responsible for any unforeseen delays to your journey to us. In the case of delays you are responsible for providing your own meals, accommodation and other travel arrangements as we do not provide you with travel to us, plus you must pay any additional cost therefore incurred.

Complaints Procedure.

(17) To Resolve Complaints: where a representative is included you should in the first instance of a complaint contact him/her at the time. If, however, you are not completely satisfied you should write to our customer relations office at Toursareus.co.uk Ltd The Panda Tweentown Cheddar Somerset BS27 3JF, this must be carried out within five days of the event date finished "i.e. 20th of the month" this must be to us by recorded post no later than the 25th of the month" (these dates are an example) this will be dealt with within 28 days in writing to you.

Legal Stuff.

(18a) Force Majeure: Toursareus.co.uk Ltd accepts no responsibility for and shall not be liable in respect of loss or damage or charges or cancellation caused by ''force Majeure'' i.e. circumstances outside our control, e-g. Cancellation or delay in the start of the event, war or threat of war, riots, civil strife, industrial dispute, terrorist activity, natural or nuclear disasters, fire or adverse weather conditions.

(18b) Protection Of Your Money: According to the 1992 Package Travel, Package Holiday and Package Tours Regulations all holiday organizers have to make provision for the protection of holidaymaker's money in the event of the company’s insolvency. In accordance with these regulations Toursareus.co.uk Ltd hold all clients’ monies in a trust account. Once any payment has been made we cannot withdraw any funds from the trust account in respect of any booking until after that event has been completed. This is to protect you the customer from any fraud so you know your money is completely safe. Any refunds will be made at this time and not until after the event completion date.

(18c) Data Protection Act -Your Card Details: The client's credit card details i.e. number - name - issue number - security number - start and finish date, are necessary at the time of booking and these details will be destroyed once final payment is taken and event is completed. No details of credit/debit or switch cards will be held on file by us in the way of electronic software accounts packages or computer storage / devices after this time.

(18d) We carry customer liability Insurance: and public liability insurance covering up to 2,000,000 (million) pounds UK Sterling. We do not cover any hotel or insure them in any way as they hold and have to comply with their country's local law and authority. This does not cover cancellation of an event or consequential loss.

(18e) ENGLISH LAW: English Law shall apply to any claim made against Toursareus.co.uk Ltd Ail proceedings shall be within the exclusive domain of the English Courts.
